Terms & Conditions

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions.


Ordering

1. Orders may be placed online via our secure checkout, over the phone or by fax.

2. All orders must be completed with full details of the customer's address, telephone numbers and e-mail.

3. For all goods in and out of stock, payment must be made in full whether goods are being collected by the customer or delivered once in stock.

The delivery charge must also be settled in full. Payment is taken automatically when ordering online. An email confirmation stating all order details will be automatically sent to the customer.

4. It is the customers’ responsibility to ensure all goods fit in their premises. We try to provide all our approximate dimensions in our listings. If no dimensions are stated, please contact us prior to ordering so we can obtain these for you.

5. We aim to keep everything in stock but as our reproduction furniture is hand-made the re-order time for goods can be between 4 -12 weeks. We aim to be as accurate as we can with delivery estimates but they are not binding. Delays may occur in shipping which we have no control of and we ask our customers to be patient should unforeseen delays occur.

6. All our dimensions aim to be as accurate as possible, however as many goods are hand made it is impossible for the craftsmen to create each piece indentically, please allow up to 3cm each way for variation.

7. All our furniture is hand made and as such some pieces may vary in colour. Every effort is made to avoid this.

8. In the event our product is listed at an incorrect price due to technical error or error in pricing information, Frenchie Interiors shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. If your credit card has already been charged for the purchase and your order is cancelled, Frenchie Interiors shall issue a credit to your credit card account in the amount of the incorrect price.

9. We aim to be as accurate as possible in our product descriptions, however manufacturers may make slight adjustments without our knowledge. In this case we will try to notify the customer as soon as possible



Delivery

1. Deliveries may made by one or two men who are not insured or authorised to deliver anywhere other than to the threshold of the property or to assist with transferring the goods into the customer's property. Please ensure that help and appropriate equipment is on hand to allow delivery.

2. All dates quoted for delivery are an estimate and may be subject to change. If this occurs we will notify and update the customer by email or via the phone.

3. Deliveries are made by either Frenchie Interiors, Parcelforce or by a 3rd party specialist furniture courier. Days and times for delivery are estimates only and shall not be made of the essence by notice.

4. On delivery you will be asked to sign a delivery note to say that the goods have been received in good order and that all ordered goods have been delivered. If there is not sufficient time to check goods for damages we ask that customers inform us within 48 hours of damages so that a replacement can be sent out or a refund can be given.

5. Goods will only be brought to the threshold of any property. It is the customers’ responsibility to arrange for the goods to be arranged within the property and is not the responsibility of Frenchie Interiors drivers or 3rd party couriers.

6. It is the customer's responsibility to ensure that all ordered goods fit into the home and that there is no restricted access. We cannot accept refund requests for goods that cannot fit into the home or cannot be delivered due to access, unsuitability or any fault of the customer.

7. Subject to the other provisions of these conditions we shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery, nor shall any delay entitle the customer to terminate or rescind the contract, unless such delay exceeds 180 days.

8. If for any reason the customer fails to accept delivery of any of the goods when they are delivered or Frenchie Interiors is unable to deliver the goods on time (because the customer has not provided appropriate access, instructions then Frenchie Interiors have the right to leave these goods with a neighbour or in a secure place on the property.

9. If sending goods abroad, we strongly advise that when the goods are delivered by Frenchie Interiors all goods should be checked in UK for any issues prior to forwarding outside of UK as Frenchie Interiors will not entertain / be liable for any issues with goods that have left the UK.


Cancellations/Refunds/Damages/Returns

1. The customer is entitled to a 7 day cooling off period from the date the order was originally placed. If the item has already been dispatched please follow our returns procedure.

2. Any free gift, which was offered at the time of purchase, must also be returned if cancelling an order.

3. Refunds may take up to 30 days and can only be refunded to the original card payment was made by.

4. Items must be checked as soon as possible, any damaged goods must be notified via email within 48 hours of delivery. We will then aim either to replace the damaged item, if it is not possible to replace due to the item being out of stock, we can offer an exchange, credit note or refund.

5. We hope customers are delighted with their purchase, however if the customer wishes to return any goods for the reason they are unhappy with their purchase, they can do so by notifying us within 48 hours and returning the goods within 14 days of delivery. Upon cancelling the contract under the DSR’s the customer agrees it is their responsibility to return the product to us.

For convenience we can arrange to have large items collected – the cost for this is the customers’ responsibility.

6. The customer is liable for any costs of return and we ask that all goods are returned in the original packaging and in perfect condition.

When the customer returns the goods to us in accordance with the contract, the customer must take reasonable care to ensure that we receive the goods and that the goods are not damaged in transit. If the customer does not exercise reasonable care and the goods are damaged, Frenchie Interiors may have a claim against them for breach of this statutory duty.

7. If returning items you are strongly recommended to obtain proof of posting and compensation should the item be lost on its return journey. We cannot accept responsibility for parcels lost or damaged in transit when being returned to us.

8. If the customer chooses to return the goods without paying the return carriage then they are in breach of contract and Frenchie Interiors has the right to forward the customers any costs incurred as a result of this.

9. If our couriers are collecting the returns and the customer doesn’t allow us access to the goods, Frenchie Interiors has the right to forward the cost of recovery to the customer.

10. In the event of us dispatching an alternative product if the original product ordered was discontinued/unavailable and it is not to the customers satisfaction, we will arrange to have the product collected and return delivery will be at our cost.


Risk/Title

1. The goods are at the risk of the customer from the time of delivery or attempted delivery.

2. Ownership of the goods shall not pass to the customer until we have received in full (in cash or cleared funds) all sums due to it in respect of the goods; and all other sums which are or which become due to Frenchie Interiors from the customer on any account.



Limitation of Liability

1. All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the contract.
2. Nothing in these conditions excludes or limits the liability of Frenchie Interiors

a) for death or personal injury caused by Frenchie Interiors negligence; or

b) under section 2(3), Consumer Protection Act 1987; or

c) for any matter which it would be illegal for Frenchie Interiors to exclude or attempt to exclude its liability; or

d) for fraud or fraudulent misrepresentation.

3. Subject to the above

i.) Frenchie Interiors total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price; and

ii.) Frenchie Interiors shall not be liable to the customer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the contract.


Refusal of Transaction & Eligibility of Purchase:

We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold; removing or editing any materials or content on the Website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.




Force Majeure

Frenchie Interiors reserves the right to defer the date of delivery or to cancel the contract (without liability to the customer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of Frenchie Interiors.
